A lawyer must not only be also a skilled litigator, but a talented negotiator. Generally, it is best for the parties to settle their case as soon as possible. Only about 10% of divorce cases actually go to trial.
When your dispute is settled, both parties save time, money and emotional turmoil. But you need an experienced negotiator who knows when to compromise and when to take a stand. If negotiations are not successful, you then need someone with courtroom experience to present your best case to the Judge for the best outcome possible. If your attorney does not have a history of litigating cases, his/her empty threats to “take it to Court” mean nothing, and end up costing you, the client. Frankly, in most towns, the judges and lawyers know those “lawyers” that settle everything and never see the inside of a courtroom as opposed to those that regularly appear in Court.
My reputation is that of a fair, yet aggressive, trial attorney. My method is to attempt a peaceful settlement and to litigate only as a last resort. An extended and expensive legal battle benefits no one. If a resolution can be reached without involving the courts, it is best for everyone concerned. However, if going to court is the only answer, then you must have an experienced, aggressive, yet fair, family law trial attorney.
But be wary of the barracuda lawyer. They promise to scorch the earth to avenge the wrongs you have suffered. They are a new breed of lawyers that have twisted our professional arena into an ugly battleground that benefits no one. They are rude to the other party’s attorney and ultimately alienate the Judge. They personalize their client’s cases and in so doing compromise the results and drive up both party’s legal bills. Lawyers take an oath to adhere to a code of conduct that promotes civility not acrimony. One does not have to be disagreeable to disagree.
With that being said, although divorce and custody matters can be a stressful and difficult experience, your choice of attorney can either heighten or lessen the turmoil. While a divorce and/or custody matter is always best resolved by agreement between the parties without court intervention, there are pitfalls in even a consensual divorce, which can be avoided by experienced counsel.
